Onko radiokanavalla soivan, alunperin varastetun kappaleen kuunteleminen autoradiosta rikos?

Ja miten se selvitetään että onko ko. henkilö tiennyt tavaran/bittien/radioaallon värähtelyn olleen varastettua?
